Products and services offered through this store may include:

• Art prints
• Original artworks
• Custom and commissioned artworks
• Subscription-based physical mailings (Active Roaming Mail Club)
• Books and poetry publications (in print and, where offered, digital editions)
• Other creative goods or services offered through the store

Minor variations in color, texture, and appearance may occur due to printing processes, screen differences, and the handmade nature of artworks. For books, minor variations in print quality between editions or print runs do not constitute a defect.

Orders and Contract Formation

A contract is formed once:

• The order is placed, and

• Payment has been successfully received or confirmed

The display of products in the online shop does not constitute a legally binding offer but an invitation to place an order. The contract is concluded when we confirm your order by email or dispatch the goods.

We reserve the right to refuse or cancel orders in case of obvious errors (e.g. pricing mistakes or technical issues).

Custom and Commissioned Artwork

Custom or commissioned artwork is created based on the customer's request and our artistic interpretation. By placing a commission order, the customer agrees that:

• The artwork is produced with a degree of artistic freedom
• Our interpretation of the brief is part of the service
• Minor stylistic differences from expectations do not constitute a defect

Production Start

Work on commissions begins only after:

• Full payment is received, and
• All necessary reference materials and instructions are provided

Revisions and Changes

Unless otherwise agreed in writing:

• Reasonable minor adjustments may be included during the process
• Significant changes after production has started may incur additional costs

Cancellation of Commissions

Once work has started, cancellation is generally not possible. If cancellation is agreed in exceptional cases, partial refunds may be issued at our discretion depending on work already completed.

Exclusion of Withdrawal Right for Commissions

Custom and commissioned artworks are excluded from the statutory right of withdrawal where they are clearly made to the customer's specifications (§ 312g (2) No. 1 BGB).

Books and Publications

Books and poetry publications sold through this store are standard print publications and are not personalised unless explicitly stated.

Physical books may be returned within the statutory 14-day withdrawal period provided they are in their original, unread condition. Please refer to the Return & Refund Policy for full details.

Where a book is also offered as a digital edition (e-book or PDF), the right of withdrawal for the digital version is lost once download or access has begun, provided you gave prior express consent at the time of purchase and acknowledged that the withdrawal right would thereby be lost.

Purchasing a book does not transfer any copyright or reproduction rights. All text, illustrations, and design elements within publications remain the intellectual property of Thac Nguyen unless otherwise stated.

Intellectual Property

All artworks, designs, illustrations, written works, and other content remain the intellectual property of Thac Nguyen and are protected under applicable copyright law.

Purchasing physical artwork, a print, or a book does not transfer copyright or any usage rights beyond personal, private enjoyment.

You may not:

• Reproduce or resell artwork or written content digitally or physically
• Modify or adapt artwork or text for commercial use
• Use artwork, illustrations, or written content for AI training datasets or machine learning purposes
• Claim authorship of any artwork, illustration, or written work

Any commercial use requires prior written permission.

Pricing and Payment

Prices include applicable taxes where required by law unless otherwise stated. Payment must be completed before production or shipping begins.

Delivery

Delivery is available worldwide where possible. Delivery times are non-binding unless expressly agreed otherwise. Delays caused by customs, shipping carriers, or circumstances beyond our control do not constitute a breach of contract.

Retention of Title

Goods remain our property until full payment has been received.

Limitation of Liability

We are not liable for indirect, incidental, or consequential damages unless required by mandatory law. Liability for damages caused by intent or gross negligence, as well as liability under the German Product Liability Act (Produkthaftungsgesetz), remains unaffected.

Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection rights of the country in which the consumer is habitually resident remain unaffected.

Dispute Resolution

We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board and do not generally do so. However, we are always willing to resolve disputes amicably directly with you.

1. Geltungsbereich

Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch selbständigen beruflichen Tätigkeit zugerechnet werden können (§ 13 BGB).

2. Vertragsschluss

Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot dar, sondern eine unverbindliche Aufforderung zur Abgabe einer Bestellung (invitatio ad offerendum).

Durch Anklicken des Bestellbuttons gibt der Kunde ein verbindliches Angebot zum Kauf der im Warenkorb enthaltenen Waren ab.

Der Vertrag kommt zustande, sobald wir die Bestellung durch eine Bestätigungs-E-Mail annehmen oder die Ware versenden.

3. Produkte und Leistungen

Das Sortiment des Shops kann folgende Produkte und Leistungen umfassen:

• Kunstdrucke
• Originalkunstwerke
• Individuelle Anfertigungen und Auftragsarbeiten
• Abonnementbasierte physische Zusendungen (Active Roaming Mail Club)
• Bücher und Lyrikpublikationen (als Druckausgabe und, sofern angeboten, als digitale Ausgabe)
• Weitere kreative Güter oder Dienstleistungen des Shops

Geringfügige Abweichungen in Farbe, Textur und Erscheinungsbild können aufgrund von Druckprozessen, Bildschirmunterschieden und der handgefertigten Natur von Kunstwerken auftreten. Bei Büchern stellen geringfügige Qualitätsunterschiede zwischen Auflagen keinen Mangel dar.

4. Preise und Zahlung

Alle Preise verstehen sich einschließlich gesetzlicher Umsatzsteuer, sofern nicht anders angegeben.

Folgende Zahlungsmethoden stehen zur Verfügung:

• PayPal
• Klarna

Die Zahlung ist unverzüglich mit Vertragsschluss fällig.

5. Lieferung und Versand

Die Lieferung erfolgt weltweit, soweit verfügbar. Lieferzeiten sind unverbindlich, sofern nicht ausdrücklich anders vereinbart. Verzögerungen durch Zoll, Versanddienstleister oder höhere Gewalt liegen außerhalb unseres Einflussbereichs und begründen keine Vertragsverletzung.

6. Eigentumsvorbehalt

Die Ware bleibt bis zur vollständigen Bezahlung unser Eigentum.

7. Individuelle Anfertigungen / Auftragsarbeiten

Individuelle Anfertigungen (Commissioned Artwork) werden nach Kundenspezifikation erstellt. Der Kunde nimmt zur Kenntnis, dass:

• eine künstlerische Gestaltungsfreiheit besteht
• geringfügige Abweichungen vom Erwartungsbild keinen Mangel darstellen

Die Produktion beginnt erst nach vollständigem Zahlungseingang sowie Klärung aller erforderlichen Angaben. Nach Beginn der Ausführung ist ein Widerruf ausgeschlossen, soweit gesetzlich zulässig (§ 312g Abs. 2 Nr. 1 BGB).

8. Bücher und Publikationen

Im Shop angebotene Bücher und Lyrikpublikationen sind Standard-Druckerzeugnisse und nicht personalisiert, sofern nicht ausdrücklich anders angegeben.

Gedruckte Bücher können innerhalb der gesetzlichen 14-tägigen Widerrufsfrist zurückgegeben werden, sofern sie sich in ihrem ursprünglichen, ungelesenen Zustand befinden. Einzelheiten entnehmen Sie bitte der Widerrufsbelehrung.

Soweit ein Buch auch als digitale Ausgabe (E-Book oder PDF) angeboten wird, erlischt das Widerrufsrecht für die digitale Version mit Beginn des Downloads oder des Zugangs, sofern der Kunde zuvor ausdrücklich zugestimmt hat und bestätigt hat, dass er sein Widerrufsrecht damit verliert.

Mit dem Erwerb eines Buches werden keine Urheber- oder Nutzungsrechte übertragen. Alle Texte, Illustrationen und Gestaltungselemente innerhalb der Publikationen unterliegen dem Urheberrecht von Thac Nguyen, sofern nicht anders angegeben.

9. Urheberrecht

Alle Inhalte – insbesondere Kunstwerke, Illustrationen, Designs und Schriftwerke – unterliegen dem Urheberrecht von Thac Nguyen und sind durch das anwendbare Urheberrecht geschützt.

Mit dem Erwerb eines physischen Werkes, eines Drucks oder eines Buches werden keine Urheber- oder Nutzungsrechte über den persönlichen, privaten Genuss hinaus übertragen.

Untersagt sind insbesondere:

• Vervielfältigung oder Weiterverkauf von Kunstwerken oder Schriftwerken in digitaler oder physischer Form
• digitale oder kommerzielle Nutzung
• Nutzung von Kunstwerken, Illustrationen oder Schriftwerken für KI-Training oder Datensätze
• Bearbeitung ohne vorherige schriftliche Zustimmung
• Inanspruchnahme der Urheberschaft an Kunstwerken, Illustrationen oder Schriftwerken

Jede kommerzielle Nutzung bedarf der vorherigen schriftlichen Genehmigung.

10. Haftung

Es gelten die gesetzlichen Haftungsregelungen. Eine weitergehende Haftung ist ausgeschlossen, soweit gesetzlich zulässig. Die Haftung für Schäden aus Vorsatz oder grober Fahrlässigkeit sowie die Haftung nach dem Produkthaftungsgesetz bleiben unberührt.

11. Anwendbares Recht

Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts (CISG). Zwingende Verbraucherschutzrechte des Staates des gewöhnlichen Aufenthalts des Verbrauchers bleiben unberührt.

Wir sind nicht verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen und nehmen grundsätzlich nicht daran teil. Wir sind jedoch stets bemüht, Streitigkeiten einvernehmlich direkt mit Ihnen zu lösen.
